YMCA Guest Release & Waiver of Liability & Indemnity Agreement

IN CONSIDERATION of being permitted to utilize the facilities, services, and programs of the YMCA for any purpose—including, but not limited to, observation or use of facilities or equipment, or participation in any off-site program affiliated with the YMCA—the undersigned, for themselves and any personal representatives, heirs, and next of kin, hereby acknowledges, agrees, and represents that they have, or will immediately upon entering or participating, inspect and carefully consider such premises and facilities or the affiliated program.

By entering the YMCA for observation, use of any facilities or equipment, or participation in an affiliated program, the undersigned acknowledges that the premises, facilities, and equipment are safe and reasonably suited for their intended purpose.

Agreement Terms

1. Release of Liability: The undersigned hereby releases, waives, discharges, and covenants not to sue the YMCA, its directors, officers, employees, and agents (hereinafter referred to as “Releasees”) from all liability. This includes any loss or damage, injury, or death, whether caused by the negligence of the Releasees or otherwise, while the undersigned is in, upon, or about the premises or participating in any YMCA-affiliated program.
2. Indemnification: The undersigned agrees to indemnify, save, and hold harmless the Releasees from any loss, liability, damage, or cost that may occur due to their presence on YMCA premises or participation in any YMCA program, regardless of cause.
3. Assumption of Risk: The undersigned assumes full responsibility for any bodily injury, death, or property damage due to negligence or otherwise while on YMCA premises, using facilities, or participating in any YMCA-affiliated program.

This Release, Waiver, and Indemnity Agreement is intended to be as broad and inclusive as permitted by the State of Colorado. If any portion is held invalid, the remaining terms shall continue in full legal force and effect.

Notice

This is a legally binding agreement. Read carefully. By signing, you waive your right to bring a court action for personal injury or property damage related to your participation in YMCA of the Pikes Peak Region’s programs and activities.

Acknowledgment of Risk

I acknowledge that participation in YMCA activities comes with inherent risks, including but not limited to:

• Slips, trips, and falls
• Aquatic injuries
• Athletic injuries
• Exposure to and infection with viruses or bacteria

This list is not exhaustive and does not limit the terms of this Agreement.

Waiver, Release, Indemnification & Covenant Not to Sue

In consideration of my participation, I, (Participant Name captured below), agree to release YMCA of the Pikes Peak Region, its officers, directors, employees, volunteers, agents, representatives, and insurers (“Releasees”) from all causes of action, claims, or demands of any nature. This includes, but is not limited to, claims of negligence, personal injury, property damage, or death arising from the use of YMCA facilities or participation in YMCA programs, whether supervised or unsupervised.

I further agree to indemnify and hold harmless Releasees from any and all claims, demands, losses, or costs arising out of my participation.

Certification

I certify that:

• I have full knowledge of the nature and extent of the risks involved.
• I am voluntarily assuming these risks.
• I am solely responsible for any loss, damage, injury, or death that may occur.
• I am in good health and have no conditions preventing my safe participation.
